can I be sued for using pictures and video taken of a friends snakes in my DVD I am making?
I am a street performing belly dancer who in exchange for my sunny performing space was allowed to video a very short, less than 5 minutes dance with a fellow performers burmese python. I intend to add this short clip and 4 stills to a DVD that I am making for private sale. Can this performer later claim that I owe him money for the use of this footage?
First, I would like to state that I'm no lawyer. My best guess would be though, either get a written statement ahead of time, signed by your friend, stating that he/she relinquishes all rights to the footage, and expects no money from any profits gained by the sale of the video. You may want to have an attorney write up a statement for you....just to be sure it is phrased correctly in order to avoid any confusion....of course signed by both you and the other party in question.
And if your friend chooses not to agree to this; well, you have one of two options. Either have an agreement drawn up (again, by an attorney) to give him/her a percentage, or simply choose NOT to use the footage, lest you end up in court over it later. There may also be copyright laws involved here too....like I said, I'm no lawyer, nor have any legal training.
I'm not sure about this sort of thing...but legal aide MIGHT be willing to help, it's worth checking out.
This might be a question better posed directly to a free law advice forum of some sort.
