Is this an enforcable contract by law?
If I go to buy a suit that's 400 euro but I walk by the shop window and see it on display in the window with a 40 euro price tag on it can I demand they sell it to me for 40 euro if even if they say it was an error by new staff member or that goods on display are merely an invitation to treat and therefore they can refuse to sell it to me for the 40 euro?
This goes right to the roots of the law of contract and as you probably know, for a contract to come into existence there has to be offer, acceptance and consideration.
Pharmaceutical Society of GB v. Boots Cash Chemists is the classic case on this and every UK law student is taught it - it was in the early days of self-service shops and the Pharmaceutical Society sued Boots for selling medicines without a qualified pharmacist present. Boots won and this is why.
It established that a price display is merely an invitation to treat. You make the offer by offering to buy the suit at the price stated. The shop can accept your offer or decline. So they are perfectly within their rights to tell you the price was a mistake and refuse to sell it to you.
